Anwar seeks to remove judge from pardon rejection challenge

KUALA LUMPUR, Aug 17 — Datuk Seri Anwar Ibrahim has applied to have High Court judge Datuk Asmabi Mohamad recused from his bid to challenge the Pardons Board rejection of his pardon request on the grounds of possible bias.

Anwar’s lawyer, Latheefa Koya, explained that they are seeking Asmabi’s withdrawal from the case on the grounds that the judge had represented the government back in 1998 when Anwar sued Putrajaya, which creates a conflict of interest.

“The case where Anwar sued the prime minister and the government, Asmabi was senior federal counsel and because of that, and now that he (Anwar) is suing the government again, there is a real danger of bias,” she said at the Kuala Lumpur High Court today.

Latheefa added that the application will be heard on September 1.

On June 24, Anwar filed a judicial review of the Pardons Board’s rejection of his royal pardon petition, claiming there was conflict of interest in former Attorney-General Tan Sri Abdul Gani Patail’s presence during the board’s disposal of the application.

State news agency Bernama also reported on June 24 they also sought a mandamus order to compel the board to reconvene a meeting and consider all materials relating to the petition for a royal pardon.

On February 24, Anwar’s family sent a request for a royal pardon on his conviction and avoid his disqualification from his Permatang Pauh seat. But on April 1, the government’s lawyers said that the Pardons Board had on March 16 rejected Anwar’s petition.

Following the decision by the Pardons Board, Anwar was disqualified as the Permatang Pauh MP, the seat which his wife Datuk Seri Dr Wan Azizah Wan Ismail later won in the March 8 by-election.

Anwar’s lawyers on April 30 also applied for a fresh Federal Court panel to review its February 10 decision to uphold a conviction and sentence him to five-years’ jail for sodomising his former political aide Mohd Saiful Bukhari Azlan.

Later on June 10, Anwar’s lawyers filed an application to have the Federal Court hear retired senior police officer Datuk Ramli Yusuff’s testimony to the alleged conspiracy to cover up the infamous “Black Eye” incident during his detention before his first sodomy trial, or “Sodomy I”.

Anwar’s legal counsel applied to have this case heard ahead of its review of Anwar’s conviction in his second sodomy case also referred to as “Sodomy II”.

PUTRAJAYA: The Federal Court has set Nov 16, to hear Datuk Seri Anwar Ibrahim's application to admit former commercial crime investigation department director Datuk Ramli Yusuff's testimony as evidence in his sodomy conviction review bid.

Federal Court deputy registrar Mohd Izzudin Mohamad fixed the hearing date after the matter came up before him for case management today.

Deputy Public Prosecutor Nadia Mohd Izhar, appearing for the prosecution said the deputy registrar had also fixed Oct 26 for case management on the matter to enable the prosecution and defence to finalise documents related to the case.

Anwar's counsel, Shahid Adli Kamarudin who was also present in the case management proceeding also confirmed the hearing date and case management date.

However, the court has yet to set a date to hear Anwar's bid to review the Federal Court's decision in upholding his sodomy guilty verdict and five-year jail sentence.

Anwar, 68, had on June 10, this year, filed an application seeking for Ramli's oral testimony to be accepted by the Federal Court and subsequently, used as evidence at the hearing of his review application.

In his notice of motion, Anwar said on May 27, this year, Ramli gave a sworn testimony at the Kuala Lumpur High Court in a civil suit, which supported his (Anwar's) defence that he was a victim of political conspiracy and fabricated evidence.

He said the evidence provided by Ramli was important to establish that there existed a political conspiracy against him which led to his being charged with sodomy.

Anwar is currently serving a five-year sentence in the Sungai Buloh Prison for sodomising his former aide, Mohd Saiful Bukhari Azlan, 30, after he lost his final appeal at the Federal Court to set aside his sodomy conviction.

Following the conviction, Anwar was disqualified as Permatang Pauh member of parliament.

He, however, had on April 30 this year, filed an application seeking from the Federal Court which had convicted him, a review of the decision.

The Court of Appeal overturned Anwar's acquittal and found him guilty of sodomising Mohd Saiful at Unit 11-5-1, Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara here, between 3.10 pm and 4.30 pm on June 26, 2008. – Bernama

This would certainly be another avenue to divert attention of the surrounding scandals and it wouldn't be any surprise if the people are thinking that he is probably the man orchestrating this rally

'Red shirt' rally to go ahead in KL despite fears of clashes

KUALA LUMPUR: A"red shirt" rally that has sparked fears of ethnic clashes is expected to go ahead on Wednesday (Sep 16) amid a high police presence, after organisers confirmed a venue.

The National Silat Federation (Pesaka) received the green light from the Kuala Lumpur City Council to hold the "anti-Bersih" Himpunan Rakyat Bersatu (United Citzens Rally) at Padang Merbok on Malaysia Day, a day to mark the formation of the Malaysian federation in 1963.

Some 250 Malay NGOs pledged support for the rally, which they said was aimed at countering last month's Bersih protest, where tens of thousands hit the streets of Kuala Lumpur calling for institutional reform and the resignation of Prime Minister Najib Razak.

Malay groups said the rally disrespected Malay leaders and ethnic Malays, who make up the majority of the population in peninsular Malaysia, and they want to teach minority "Chinese from opposition party DAP" a lesson.

Malaysia's Inspector General of Police Khalid Abu Bakar said that the rally's organisers have complied with legal requirements so it is permitted to go ahead but there will be a high police presence to ensure public safety and order.

Messages have been circulating on social media and messaging services warning non-Malays to stay away from the city centre over fears of ethnic clashes.

But the police chief said the public should not worry as authorities will be on standby and will be monitoring the speeches for seditious content.

"We are capable of ensuring security and safety ... Don't believe the messages circulating that Chinese shouldn't come out," said Khalid. "To me, these are the actions of people who want to purposely create fear among ethnic groups."

Last week, Prime Minister Najib acknowledged that some leaders and members of his party UMNO planned to participate in the rally, though they were not organising it. He said UMNO did not support anything of a racist nature but he would not be directing members to not participate.

Malay solidarity aside, many say they are attending the rally to show support for their prime minister, and other UMNO leaders. Najib continues to be plagued by allegations of corruption, despite his repeated denials.

No charges have been brought against him so far.

Now, a 2006 murder scandal he was linked to in the past has resurfaced. The Prime Minister says a recent current affairs programme about the murder of the Mongolian translator Altantuya is yet another step in a plot to oust him from government.

Malaysia's police chief agrees, as was seen in his heated exchange at a news conference on Monday with a journalist from Al Jazeera which produced the programme.

"You are trying to confuse the people, you are trying to create something else from nothing ... Whatever it is, we are commencing our investigation on Al Jazeera," said Khalid.

This was not the first time Malaysia has linked the media to a plot to discredit Najib.

In July, the Prime Minister threatened to sue the Wall Street Journal, and the government also blocked access to the Sarawak Report website after both news outlets published allegations that some US$700 million had been channelled into his personal bank accounts in 2013.

MALAYSIAN FOREIGN MINISTER CONDEMNS "TIT-FOR-TAT" RALLY

Malaysian Foreign Minister Anifah Aman said the planned Sep 16 rally should not be in retaliation to the Bersih protest.

"Bersih 4.0 was made illegal and I believe should ‘Himpunan Rakyat Bersatu’ have an objective that is not about unity and celebrating Hari Malaysia then it too should be made illegal," said Mr Anifah.

"There is also no harm in wearing a red shirt on Hari Malaysia if it is to celebrate Hari Malaysia and represent unity among all races, however should it be worn just for provocation then that I believe is wrong - the same way wearing the yellow shirt to create provocation is wrong."

He added: "Hari Malaysia should not be about racial, political nor religious hatred. We must embrace the true meaning of Hari Malaysia.

"An unguarded tit-for-tat action or reason can be detrimental to the peace and harmony enjoyed by Malaysians and no doubt effect the economic well-being of the country. We as a nation must be above these kind of narrow minded thinking.

"Hari Malaysia is for all Malaysians to demonstrate their love for the country and not to instigate hatred nor racial supremacy."
