1MDB investigations will continue
The Star/Asia News NetworkThursday, Jun 25, 2015 The Public Accounts Committee (PAC) probe into 1Malaysia Development Berhad (1MDB) will not be influenced by the arrest of a former PetroSaudi International employee - at least for now. "The PAC investigations on 1MDB will continue as planned. Our probe is about the governance of the organisation and issues of any wrongdoing are only part of our investigations," said PAC chairman Datuk Nur Jazlan Mohamed when contacted yesterday. He said neither the arrest of Xavier Justo (pic) nor the alleged doctoring of documents released by him would affect the committee's investigations. However, he also qualified this by saying: "Our job is to consider any information including the PetroSaudi deal and interview witnesses to verify the authenticity of the information." Nur Jazlan, who is currently abroad, said the committee would sift through the information and evidence gathered during its hearing to come to its own findings. PAC deputy chairman Dr Tan Seng Giaw echoed similar sentiments, saying the arrest of Justo was "an issue between PetroSaudi and a former employee". "He is not employed by the Finance Ministry, which owns 1MDB," he said. Dr Tan said the bipartisan committee was focused on 1MDB's dealings and transactions in entirety and were not confined to the PetroSaudi deal. "Our concerns are those expressed by the rakyat as it involves a large amount of public funds. "Where did 1MDB get its money, how was it spent and where is the money now?" he asked, adding that PAC was answerable to Parliament. Nur Jazlan and Dr Tan were asked to comment on the leaked documents by Justo to online portal Sarawak Report. Justo was arrested at his home in Thailand on Monday and was charged with attempted blackmail and extortion against his former employer. The PAC has so far called 1MDB auditors Deloitte and KPMG to testify before it. 1MDB's president and group executive director Arul Kanda Kandasamy, and its former chief executive officer Datuk Shahrol Azral Ibrahim Halmi will appear before the committee on Aug 4 and 5. Also to be called are the company's board of directors. "This interpretation of my tweet is certainly incorrect." He added: "Singaporean Malays, although a minority, are also not marginalised. Many of them are happy with the Singaporean Government and it would be silly for the PAP (People's Action Party) to even think of discriminating against Malays and risk forfeiting 15 per cent of the vote." "RETORT WAS THAT DR MAHATHIR WAS WRONG": ZAID In a tweet on Jun 21, Mr Zaid had said: "Sorry Tun if under Najib Malays here will become like Spore Malays; I will give him full support. Malays under Najjb will be Talibans." The former Law Minister on Wednesday said that the tweet was in response to former Malaysia Prime Minister Dr Mahathir Mohamad's statement that "Prime Minister Datuk Seri Najib Razak would make the local Malays more like Singaporean Malays – that is, allegedly 'second-class citizens' and marginalised." "My retort was that Dr Mahathir was wrong," said Mr Zaid. "Najib would make Malays like the Taliban, but if under Najib Malays here grew to become like Malays in Singapore, then I would be happy to support him." In a video released by blogger Din Turtle on Jun 20, Dr Mahathir addressed a closed-door forum by the Perdana Leadership Foundation, saying: “If we don’t acknowledge the crime that is happening here, there is a high likelihood that we will lose and we will be divided ... And we will suffer the fate of the Malays in Singapore, in southern Thailand and other places.” “Now we are thankful because we are still in power but if Najib leads the country, we will lose that power in our hands and at that point, there won’t be anyone there to offer us protection," Dr Mahathir added, according to The Malay Mail Online. Said Mr Zaid in his statement on Wednesday: "No one wants to see Malays marginalised and poor - certainly not me. Malays should be given the best opportunities to improve and they deserve much more than what they currently have." SINGAPOREAN MALAYS REAP BENEFITS OF MODERN ADVANCED ECONOMY: ZAID Mr Zaid also said that he wished Malays in Malaysia were more like those in Singapore. "Singaporean Malays do not have the same 'special treatment' as their Malaysian counterparts, so you could say that they are worse off than us," he said. 1MDB claims leaked PetroSaudi emails tampered with

"1MDB notes press reports today on the arrest of a former PetroSaudi staff for attempted blackmail and extortion in relation to proprietary email information belonging to PetroSaudi. We further note that initial probes show that some leaked emails were tampered with," it said in a statement on Wednesday. 1MDB said it would co-operate with authorities and were confident that the probe would be conducted thoroughly. "1MDB is confident that the lawful authorities will thoroughly investigate, establish the facts and take appropriate action under the law. As stated previously, 1MDB pledges its full co-operation with the lawful authorities in their ongoing investigations on this matter," it said. On Wednesday, Thailand's Bangkok Post, quoting acting commander of the Royal Thai Police's Crime Suppression Division, Pol Col Akaradech Pimonsri said that former PetroSaudi exec Xavier Justo, 49, was paid the equivalent of 140mil baht (S$5.54 million) to leave the company after he was found to have "behaved against the company's rules and regulations." Pimonsri also accused the former IT executive of demanding another 90mil bath from the company in exchange for not disclosing confidential information to rival companies. Justo was arrested at a house at Koh Samui on Monday, allegedly for leaking information information to the London-based Sarawak Report website for several reports about 1Malaysia Development Berhad (1MDB). Justo has denied the allegations. On Tuesday, PetroSaudi said that they had been "the victims of a regrettable crime that has unfortunately been politicised in Malaysia" via a press statement. PetroSaudi added that they are happy to "finally set the record straight." PetroSaudi had become embroiled in the 1MDB controversy after a joint-venture deal between the two companies was said to have been orchestrated by business tycoon Low Taek Jho. |

POSTED: 30 Jun 2015 08:44 KUALA LUMPUR: Prime Minister Najib Razak’s supporters do not seem to understand that state investment vehicle 1Malaysia Development Bhd (1MDB) had borrowed RM42 billion (S$15 billion) to dabble in “shady businesses”, resulting in a loss of money, said former Prime Minister Mahathir Mohamad on Monday (Jun 29). In his latest blog post, Dr Mahathir said that in the process, a “large amount of money had disappeared”. Referring to a recent announcement in the London Stock Exchange that International Petroleum Investment Company (IPIC), backed by the Abu Dhabi government, would undertake some of 1MDB’s debts in return for a transfer of assets, the former Premier said no mention had been made of which 1MDB asset would belong to IPIC. “If it is the power plants or the land (that 1MDB had purchased using public funds), it would mean that these assets are no longer 1MDB’s to sell. So how does 1MDB recover the RM42 billion it has borrowed (from the government)?” he asked. Dr Mahathir noted that the entire restructuring of the beleaguered state investment vehicle seemed to be about selling off assets to clear the loan. 1MDB has maintained that the value of its assets can offset the RM42 billion debt, though its cash flow struggles have led to a restructuring exercise. “The money is to come from the sale of TRX (Tun Razak Exchange) and Bandar Malaysia land. 1MDB paid an extremely low price for this land. But can 1MDB do so?” he asked. Dr Mahathir added that the money borrowed by 1MDB had been used to buy Independent Power Producer (IPP) at inflated prices. 1MDB is currently being investigated by the Auditor-General and the bipartisan parliamentary Public Accounts Committee (PAC) over its dealings. Commenting that on the recent arrest of a PetroSaudi International executive who had tampered and leaked email correspondence between the company and 1MDB, Dr Mahathir said the arrest had no bearing on the fact that the two companies had entered a “worthless” joint venture. He said the arrest of the executive, Mr Xavier Justo, by the Thai authorities on charges of blackmail did not change the fact that 1MDB had entered into a lopsided deal with PetroSaudi and overpaid for energy assets. “Even if Justo had tampered with the emails, it doesn’t alter the fact that 1MDB had forked out US$1.9 billion (S$2.57 billion) for the joint venture with PetroSaudi, which within six months became so worthless that it was aborted,” Dr Mahathir wrote. He also ridiculed those who were demanding an apology for the criticism of 1MDB following Mr Justo’s arrest.“Some people are very excited about Justo. Now, they say the critics of the Prime Minister should apologise. Apologise for what?” Dr Mahathir said. “The fact remains that vast amounts of money have disappeared. Can Justo bring all the money back?” asked the former Premier, who has been outspoken against the failings of 1MDB, saying Mr Najib should step down over the scandal. Dr Mahathir was responding to comments on Monday by Second Finance Minister Ahmad Husni Hanadzlah, who said the Justo case had much impact on 1MDB. “Before (the arrest), 1MDB was seen as a ‘fragile’ company involved in scandals and facing various ‘online’ accusations,” said the minister. “With the arrest of Justo, and based on what he has said, it is clear that the various issues concerning 1MDB did not arise and that it was on the right track,” he added. PKR to file suit to nullify BN’s GE13 win over WSJ expose
BY SYED JAYMAL ZAHIID PETALING JAYA, July 8 — PKR will file a civil suit to declare the results of Election 2013 null and void, following the Wall Street Journal’s (WSJ) expose that US$700 million (RM2.6 billion) from 1Malaysia Development Berhad (1MDB) had been transferred into Prime Minister Datuk Seri Najib Razak’s personal accounts, some purportedly during the heated campaign for the federal polls. PKR vice-president Nurul Izzah Anwar said the suit was imperative as the legitimacy of the 13th general election and BN’s rule have been brought into disrepute by the exposé. “Keadilan will file the suit to nullify the 13th general election results, especially those (seats) held by BN-Umno post-expose by WSJ and Sarawak Report with regards to the embezzlement of funds for elections that involved the prime minister and Umno president. The Lembah Pantai MP claimed that although the staggering sum used to finance the ruling coalition’s campaign was a breach of election laws, the opposition cannot rely on the Election Commission to take necessary action given its track record of alleged preferential treatment towards BN. “The EC, true to its expected form and nature, cannot be expected to take action. “The EC’s past conduct - ranging from the civil suit it faced following the indelible ink fiasco, the various inaction to pledges of political bribery implicating government ministers, to the appeal it made following Sarawak PKR’s success in achieving a High Court decision mandating the EC to redo Sarawak’s re-delineation process in accordance with Schedule 13 of the Federal Constitution - have severely eroded its credibility,” Nurul Izzah said. After a meeting between rights groups members and opposition lawmakers yesterday, Datuk Ambiga Sreenevasan said BN must hand over power to a caretaker administration and hold a general election by next year over claims the prime minister received funds from 1MDB. The social activist said this was necessary as the alleged corruption may involve other leaders in the Najib administration. Ambiga added that an interim government will ensure a proper investigation into the claim linking 1MDB funds to Najib. Anwar seeks to remove judge from pardon rejection challenge

Anwar’s lawyer, Latheefa Koya, explained that they are seeking Asmabi’s withdrawal from the case on the grounds that the judge had represented the government back in 1998 when Anwar sued Putrajaya, which creates a conflict of interest. “The case where Anwar sued the prime minister and the government, Asmabi was senior federal counsel and because of that, and now that he (Anwar) is suing the government again, there is a real danger of bias,” she said at the Kuala Lumpur High Court today. Latheefa added that the application will be heard on September 1. On June 24, Anwar filed a judicial review of the Pardons Board’s rejection of his royal pardon petition, claiming there was conflict of interest in former Attorney-General Tan Sri Abdul Gani Patail’s presence during the board’s disposal of the application. State news agency Bernama also reported on June 24 they also sought a mandamus order to compel the board to reconvene a meeting and consider all materials relating to the petition for a royal pardon. On February 24, Anwar’s family sent a request for a royal pardon on his conviction and avoid his disqualification from his Permatang Pauh seat. But on April 1, the government’s lawyers said that the Pardons Board had on March 16 rejected Anwar’s petition. Following the decision by the Pardons Board, Anwar was disqualified as the Permatang Pauh MP, the seat which his wife Datuk Seri Dr Wan Azizah Wan Ismail later won in the March 8 by-election. Anwar’s lawyers on April 30 also applied for a fresh Federal Court panel to review its February 10 decision to uphold a conviction and sentence him to five-years’ jail for sodomising his former political aide Mohd Saiful Bukhari Azlan. Later on June 10, Anwar’s lawyers filed an application to have the Federal Court hear retired senior police officer Datuk Ramli Yusuff’s testimony to the alleged conspiracy to cover up the infamous “Black Eye” incident during his detention before his first sodomy trial, or “Sodomy I”. Anwar’s legal counsel applied to have this case heard ahead of its review of Anwar’s conviction in his second sodomy case also referred to as “Sodomy II”. |

Federal Court deputy registrar Mohd Izzudin Mohamad fixed the hearing date after the matter came up before him for case management today. Deputy Public Prosecutor Nadia Mohd Izhar, appearing for the prosecution said the deputy registrar had also fixed Oct 26 for case management on the matter to enable the prosecution and defence to finalise documents related to the case. Anwar's counsel, Shahid Adli Kamarudin who was also present in the case management proceeding also confirmed the hearing date and case management date. However, the court has yet to set a date to hear Anwar's bid to review the Federal Court's decision in upholding his sodomy guilty verdict and five-year jail sentence. Anwar, 68, had on June 10, this year, filed an application seeking for Ramli's oral testimony to be accepted by the Federal Court and subsequently, used as evidence at the hearing of his review application. In his notice of motion, Anwar said on May 27, this year, Ramli gave a sworn testimony at the Kuala Lumpur High Court in a civil suit, which supported his (Anwar's) defence that he was a victim of political conspiracy and fabricated evidence. He said the evidence provided by Ramli was important to establish that there existed a political conspiracy against him which led to his being charged with sodomy. Anwar is currently serving a five-year sentence in the Sungai Buloh Prison for sodomising his former aide, Mohd Saiful Bukhari Azlan, 30, after he lost his final appeal at the Federal Court to set aside his sodomy conviction. Following the conviction, Anwar was disqualified as Permatang Pauh member of parliament. He, however, had on April 30 this year, filed an application seeking from the Federal Court which had convicted him, a review of the decision. 'Red shirt' rally to go ahead in KL despite fears of clashes By Sumisha Naidu POSTED: 14 Sep 2015 12:45 UPDATED: 15 Sep 2015 00:18 KUALA LUMPUR: A"red shirt" rally that has sparked fears of ethnic clashes is expected to go ahead on Wednesday (Sep 16) amid a high police presence, after organisers confirmed a venue. The National Silat Federation (Pesaka) received the green light from the Kuala Lumpur City Council to hold the "anti-Bersih" Himpunan Rakyat Bersatu (United Citzens Rally) at Padang Merbok on Malaysia Day, a day to mark the formation of the Malaysian federation in 1963. Some 250 Malay NGOs pledged support for the rally, which they said was aimed at countering last month's Bersih protest, where tens of thousands hit the streets of Kuala Lumpur calling for institutional reform and the resignation of Prime Minister Najib Razak. Malay groups said the rally disrespected Malay leaders and ethnic Malays, who make up the majority of the population in peninsular Malaysia, and they want to teach minority "Chinese from opposition party DAP" a lesson. Malaysia's Inspector General of Police Khalid Abu Bakar said that the rally's organisers have complied with legal requirements so it is permitted to go ahead but there will be a high police presence to ensure public safety and order. Messages have been circulating on social media and messaging services warning non-Malays to stay away from the city centre over fears of ethnic clashes. But the police chief said the public should not worry as authorities will be on standby and will be monitoring the speeches for seditious content. "We are capable of ensuring security and safety ... Don't believe the messages circulating that Chinese shouldn't come out," said Khalid. "To me, these are the actions of people who want to purposely create fear among ethnic groups." Last week, Prime Minister Najib acknowledged that some leaders and members of his party UMNO planned to participate in the rally, though they were not organising it. He said UMNO did not support anything of a racist nature but he would not be directing members to not participate. Malay solidarity aside, many say they are attending the rally to show support for their prime minister, and other UMNO leaders. Najib continues to be plagued by allegations of corruption, despite his repeated denials. No charges have been brought against him so far. Now, a 2006 murder scandal he was linked to in the past has resurfaced. The Prime Minister says a recent current affairs programme about the murder of the Mongolian translator Altantuya is yet another step in a plot to oust him from government. Malaysia's police chief agrees, as was seen in his heated exchange at a news conference on Monday with a journalist from Al Jazeera which produced the programme. "You are trying to confuse the people, you are trying to create something else from nothing ... Whatever it is, we are commencing our investigation on Al Jazeera," said Khalid. This was not the first time Malaysia has linked the media to a plot to discredit Najib. In July, the Prime Minister threatened to sue the Wall Street Journal, and the government also blocked access to the Sarawak Report website after both news outlets published allegations that some US$700 million had been channelled into his personal bank accounts in 2013. "Bersih 4.0 was made illegal and I believe should ‘Himpunan Rakyat Bersatu’ have an objective that is not about unity and celebrating Hari Malaysia then it too should be made illegal," said Mr Anifah. "There is also no harm in wearing a red shirt on Hari Malaysia if it is to celebrate Hari Malaysia and represent unity among all races, however should it be worn just for provocation then that I believe is wrong - the same way wearing the yellow shirt to create provocation is wrong." He added: "Hari Malaysia should not be about racial, political nor religious hatred. We must embrace the true meaning of Hari Malaysia. Umno’s Saifuddin Abdullah to join PKR

He will be unveiled as a PKR member at a press conference at the PKR headquarters in Petaling Jaya at noon tomorrow, The Malaysian Insider has learnt. Saifuddin, a former Temerloh MP, was recently served a show cause letter by Umno for attending the roundtable discussion that led to the formation of the new opposition coalition Pakatan Harapan. "Yes, he is joining us," a senior party leader told The Malaysian Insider on the condition of anonymity. The Malaysian Insider has called and texted Saifuddin to verify the news but there is no reply as of press time. Opposition leader and PKR president Datuk Seri Dr Wan Azizah Wan Ismail is to announce Saifuddin's membership at the party's headquarters at noon tomorrow. The party also issued a notice to the media tonight calling for coverage of a press conference at the same time tomorrow, where new members from Umno would be unveiled. Party sources said Saifuddin is expected to play a prominent role in the newly-formed opposition coalition Pakatan Harapan. The Malaysian Insider understands that plans are afoot to appoint the former deputy minister as executive secretary to the three-party pact, that also includes DAP and Parti Amanah Negara (Amanah). This, however, is subject to endorsement from the other two coalition partners. Saifuddin, 54, who is a former Umno supreme council member, was appointed as deputy minister under Tun Abdullah Ahmad Badawi's administration. He was one of Umno's more progressive leaders, with his views often putting him at odds with his more hardline colleagues. Despite his popularity with urban Malaysians, he lost his seat at the 2013 general election to PAS's Nasrudin Hassan. After his loss, he was more active in civil society work, giving talks and attending forums by virtue of his position as the CEO of Global Movement of Moderates (GMM) Foundation as well as heading Akademi Belia. You could be right.
Than again, if they switch camps, the leadership of the Opposition parties won't be changed to ex-UMNO unless the person shows their value and work up the ranks. Thus, if there are enough switching sides, BN will be weaken significantly. This can cause the BN to loose ground in next GE. Politics, can't really tell till it happens. Saifuddin: I’m attracted to multi-racial model of PKR
BY RASHVINJEET S. BEDI AND DANIAL ALBAKRI PETALING JAYA: Datuk Saifuddin Abdullah (pic) says that he joined PKR because he feels that he does not fit in with Umno and Barisan National. Saifuddin said that he was attracted by PKR's multi-racial model, unlike that of BN, which he claimed practised communal politics. He said other parties had approached him as well but his heart was with PKR. "I consider this a big decision for a small person such as myself," he told a packed press conference at the PKR headquarters on Thursday. He also said that he would tender his resignation as the CEO of Global Movement of Moderation (GMM) when its chairman Tan Sri Razali Ismail returned from overseas. Saifuddin, a former deputy minister, was recently issued a show-cause letter by Umno for attending a roundtable discussion of the Opposition parties at Empire Hotel in Subang on Sept 21. Umno secretary-general Datuk Seri Tengku Adnan Tengku Mansor said Saifuddin’s motives for attending the meeting, which led to the formation of Pakatan Harapan, were questionable even though he was there in his capacity as an NGO leader. In the 2013 general election, Saifuddin lost his Temerloh parliamentary seat to PAS. He also lost his place on the Umno Supreme Council in the party elections the same year. --------------- Comparing his reason, to that of what najib said about the racial disharmony being temporary, I have more faith in Saifuddin's intention. Malaysia shd stop playing racial and religious cards. They are just denting themselves on the global stage and causing discontent internally, which will be very damaging on the long run. Looking at Indonesia during the fall of Suharto, till now, I don't think the ethic chinese feels at ease. There are many M'sia Chinese that also felt the same for the longest time. |
